Michigan House approved clarifies the enforcement of prenups

The Michigan House on Thursday has approved legislation to clarify the enforcement of prenuptial agreements. This bill was approved 63-43 votes. Under this bill courts cannot enforce a prenuptial if its terms are “unconscionable”.

This legislation will provide instances where prenups are unenforceable. They are cases of fraud, mistake or duress or if financial information is kept hidden from another party before signing.

The only worry is that Judges could disregard a contract without this bill. And this could lead to application of standard of living test which will eventually distribute marital property. Meanwhile, critics are worried that this bill would prevent judges from looking at the wholesomeness of circumstance. And the bill has now moved to the Senate.
